ANOTHER SERIOUS VIOLATION OF INTERNATIONAL HUMANITARIAN LAW IS RECORDED ON THE PART OF REPRESENTATIVES OF ILLEGAL ARMED GROUPS MANAGED BY THE RUSSIAN FEDERATION
Reportedly, representatives of illegal armed groups shelled residential houses, recorded on video their own crimes against civilians and Ukrainian servicemen, who are defending suburbs of Marinka
Probably the shelling of residential houses by the militants came from the residential area. In the video, published by the press service of the 24th Mechanized Brigade named after King Danylo in Facebook shelling is conducted by the militants probably from living area of settlement Oleksandrivka Donetsk Oblast. Neglecting the life and security of civilians, these daring criminal activities are being implemented to encourage representatives of the Armed Forces of Ukraine to rise to this provocation.
Such actions by representatives of illegal armed groups subordinated to the Russian Federation once again testify to their systematic violations of the norms of international humanitarian law.
Indeed, according to Article 52 of the Additional Protocol to the Geneva Conventions from 12 August 1949, relating to the protection of victims of international conflicts (Protocol I), dated 8 June 1977 (hereinafter referred to as «AP I») civilian objects shall not be the object of attack or of reprisals.
Furthermore, Article 57 of the AP І established that during military operations constant care shall be taken to spare the civilian population, civilians and civilian objects.
In addition, the specified act is a war crimewithin the jurisdictional competence of the International Criminal Court. In particular, as contained in Rome Statute of the International Criminal Court, Article 8.
A strict compliance with the norms of international humanitarian law (hereinafter referred to as "IHL") by the Armed Forces of Ukraine should be noted. Thus, to ensure compliance with the norms of IHL by the Ukrainian servicemen and other units involved in the defense of our country against the aggressor, constant explanatory work is being carried out at the departmental and state levels with the participation of the International Committee of the Red Cross and other partners.
Specifically, on 22 February 2018 on the initiative of MTOT meeting of the Inter-Departmental Commission was held on the Application and Implementation of International Humanitarian Law in Ukraine, headed by Minister Vadym Chernysh, dedicated to the combat actions in urban terrain environment and its consequences.
