THE GOVERNMENT HAS ESTABLISHED A MONETARY COMPENSATION MECHANISM FOR DESTROYED PRIVATE HOUSING AS A RESULT OF ARMED AGGRESSION OF THE RUSSIAN FEDERATION

On 10 July 2019 the relevant decision was made at a meeting of the Government on the initiative of the Ministry for Temporarily Occupied Territories and Internally Displaced Persons of Ukraine (hereinafter referred to as «MTOT»)

From now on, owners of residential buildings (apartments) that were destroyed as a resultof the armed aggression of the Russian Federation in the East of Ukraine will be able to receive monetary compensation from the state.

The amount of compensation obtained by affected persons will be determined by the indicators of the cost of housing construction in the relevant Oblasts of Ukraine, while its maximum amount will be 300 000 UAH.

In accordance with the adopted mechanism, local bodies (civil-military administrations) will conduct surveys on housing destroyed as a result of the armed aggression of the Russian Federation and issue appropriate Acts to affected persons. For example, according to the information of the Civil–military administration of Luhansk Oblast as of 1 June 2019 there are 393 destroyed private houses in Luhansk Oblast.

In order to receive compensation, affected persons should submit appropriate applications and documents to specially created commissions under regional state administrations (regional civil-military administrations), which will decide on the provision of monetary compensation.

The forms of the necessary documents and the procedure for the consideration of applications should be developed by MTOT.

Funds for provision of monetary compensation for destroyed housing will be provided in the state budget of Ukraine.

It should be noted that the developed mechanism is based on the principles of providing financial assistance to affected persons of emergencies stipulated by the Code of Civil Protection of Ukraine, taking into account the fact that since 26 January 2015, an emergency state level of a military nature has been established in Donetsk and Luhansk Oblasts*

Since 2014, the Russian Federation has been committing the crime of armed aggression against Ukraine and temporarily occupied a part of its territory. The consequence of these actions of the aggressor-country was the destruction of a significant amount of housing for citizens in the East of Ukraine. Such actions violated the right to housing and compromised the provision and observance of other fundamental human rights. The Government of Ukraine is taking every possible action to assist civilians affected by the armed aggression of the Russian Federation.
